56k modem is not connecting at 40k or faster.
Solution:
Modem connection speeds can vary greatly from day to day and from
connection to connection. If your typical connections don't seem
to go over 40k (40000 bps), you typically need to see about updating
your modem's firmware and drivers.
If your computer is a name brand system (i.e. Compaq, Dell, Pionex,
Gateway, Apple), visit their web site first. They may have the drivers
you need right there.
If your modem was purchased separately or if your computer was "built up", consult the manual for your modem to find the manufacturer's web site to get updates.
